Terms of Service

By registering with the Dwarf Paradox Site Monitoring service, you agree to these Terms of Service.

Authorization

By activating the Dwarf Paradox Site Monitoring service, you agree that you own or have written authorization to use our service from the legal owner of the URL(s) or IP address(es) to be monitored.

Our service shall only be used in accordance with any and all applicable laws and regulations.

Account Information

Account holders and/or users must keep their personal registration information (name, billing details and contact data) accurate, complete and up to date. Dwarf Paradox Pty Ltd reserves the right to verify this information from time to time and to terminate without notice any accounts found in non-compliance with this requirement.

Disclaimer

The account holder and/or user agrees to indemnify and not hold responsible Dwarf Paradox Pty Ltd, its directors, employees, contractors, parent or subsidiary businesses for any claim howsoever arising, including legal fees, from the use of the Dwarf Paradox Site Monitoring service.

Dwarf Paradox Pty Ltd does not warrant that this service will be error-free or uninterrupted, and reserves the right to alter or restrict the services at any time.

The account holder and/or user agrees that Dwarf Paradox Pty Ltd will not be responsible for any unauthorized access to the account holder's account, for messages received or not received when using the Service, or any loss incurred due to any failure of this service.

Dwarf Paradox’s liability for negligence or breach of contract with regard to the Dwarf Paradox Site Monitoring service is limited, to the maximum extent permitted by law, to the resupply of Dwarf Paradox Site Monitoring services or refund of account credit.

This agreement is governed by the law in force in the State of Tasmania and Australia.

Privacy Policy

General

Information received from you is strictly confidential. Dwarf Paradox Pty. Ltd. undertakes not to reveal, disclose, sell, distribute, rent, licence, share, or pass on to any third parties, other than where legally required, any information, data or documentation that you may have provided to us unless we have your expressed permission to do so.

Dwarf Paradox is committed to supporting the 'National Privacy Principles for the Fair Handling of Personal Information' which set clear standards for the collection, access, storage and use of personal information which we obtain as part of our business operations.

Our respect for the personal information of our customers is paramount. We have policies and procedures to ensure that all personal information, no matter how or where it is obtained, is handled sensitively, securely, and in accordance with the National Privacy Principles.

  • Generally, what sort of information we hold, for what purposes, and how we collect, hold, use and disclose that information.

So that we can provide services to you, we may ask for personal details such as your name, address, telephone number, credit card number or e-mail address. Some examples of where we may need these details are delivery of products, payment of purchases or correspondence. Privacy law requires us to collect personal information about you only from you if it is reasonable and practical to do so.

Dwarf Paradox takes measures to ensure your personal information is protected from unauthorised access, loss, misuse, disclosure or alteration. We also take measures to destroy or permanently de-identify personal information when it is no longer required. The types of measures we take vary with the type of information, and how it is collected and stored.

Generally, you have no obligation to provide any information requested by us. If you choose to withhold requested information however, we may not be able to provide you with the goods and services that depend on the collection of that information, particularly if the collection of that information is required by law.

How is personal information used?

The personal information that we ask for is generally used to provide goods or services to you. For example, for a credit card transaction we need your card number, and for correspondence we need your contact details so we can contact you if necessary.

We have no intention to use your personal details other than for the main purpose for which we have collected them. We will not use your personal details for mail outs, advertising or for any other secondary purposes.

Access to your personal information

We will provide you with access to any of your personal information we hold (except in the limited circumstances recognised by privacy law).

If you require access to your personal information, please contact us using one of the methods detailed in our Contact Details. Of course, before we provide you with access to your personal information we will require some proof of identity. Your information will be provided free of charge.

Generally there is no need to update our records with your personal information if it changes, as it is not required for any secondary purposes.
